Terms of Service

Welcome to Remi.

These Terms of Service (“Terms”) govern your access to and use of Remi, including our website, web app, mobile apps, event galleries, QR code event access, photo capture features, storage features, and related services.

Remi (“Remi,” “we,” “us,” or “our”) provides a disposable-camera style event photo app that allows a host to create an event, invite guests by link or QR code, limit the number of photos guests can take, and collect those photos into a shared event gallery.

By creating an account, creating an event, joining an event, uploading or capturing photos, accessing a gallery, purchasing a paid feature, or otherwise using Remi, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use Remi.

1. Eligibility

You must be at least 13 years old to use Remi.

If you are under the age of majority where you live, you may use Remi only with the consent and supervision of a parent or legal guardian.

You may not use Remi if you are prohibited from using the service under applicable law.

2. Accounts

You may need to create an account to use certain Remi features, including creating events, managing galleries, accessing restricted galleries, or claiming photos.

You agree to provide accurate and complete information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately if you believe your account has been accessed without authorization.

We are not responsible for losses caused by unauthorized use of your account, unless required by applicable law.

3. Hosts and Guests

Remi allows users to participate in events as hosts, guests, viewers, or participants.

A “host” is the person or organization that creates or manages an event.

A “guest” or “participant” is a person who joins an event, scans a QR code, takes photos, uploads content, views a gallery, or otherwise interacts with an event.

Hosts are responsible for:

  • choosing appropriate event privacy settings;
  • inviting only appropriate participants;
  • controlling and protecting event links and QR codes;
  • communicating event rules and gallery visibility settings to guests;
  • obtaining any required consent before collecting, uploading, or sharing photos of others;
  • handling reasonable requests from guests relating to event content;
  • ensuring that their use of Remi complies with applicable laws.

Guests are responsible for:

  • only joining events they are authorized to access;
  • not sharing private event links or QR codes with unintended recipients;
  • not uploading or capturing unlawful, harmful, private, or unauthorized content;
  • respecting the privacy and rights of others.

Remi provides the platform, but hosts and users are responsible for how they use the platform.

4. Event Visibility and Shared Galleries

Photo and gallery visibility depends on the host’s event settings.

Depending on the event configuration, guests may be able to see only their own photos, see all event photos, or access the full gallery only after a certain time, such as after the event ends.

A gallery may be limited to participants, restricted to invited email addresses, or accessible to anyone with the link, depending on the host’s settings.

If a gallery or event link is shared, anyone who receives that link may be able to access the gallery, depending on the event settings.

You understand and agree that Remi cannot control what hosts, guests, viewers, or other recipients do with photos after they access them. Users may download, screenshot, copy, repost, share, or otherwise use content outside of Remi.

Remi is not responsible for unauthorized sharing by hosts, guests, participants, viewers, or third parties.

5. User Content

“User Content” means any content submitted, uploaded, captured, stored, shared, displayed, or otherwise made available through Remi, including photos, event names, cover images, names, captions, comments, profile information, and other materials.

You retain ownership of your User Content, subject to the rights granted in these Terms.

You are solely responsible for your User Content and for the consequences of submitting, uploading, capturing, storing, sharing, or displaying it through Remi.

You represent and warrant that:

  • you own or have the necessary rights, permissions, and consents to use and share your User Content through Remi;
  • your User Content does not violate any law, contract, privacy right, publicity right, intellectual property right, or other right of any person or organization;
  • your User Content does not contain unlawful, harmful, abusive, defamatory, obscene, exploitative, hateful, invasive, or otherwise prohibited material;
  • you have obtained any required consent from people who appear in your photos, including parents or guardians where minors are involved.

6. Licence You Grant to Remi

You grant Remi a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, upload, display, reproduce, process, transmit, distribute, modify for technical purposes, and otherwise use your User Content only as necessary to operate, provide, maintain, secure, promote, and improve Remi.

This licence allows us to:

  • store photos and event content;
  • display photos in event galleries according to event settings;
  • generate thumbnails, previews, and compressed versions;
  • transmit content to authorized users;
  • back up and secure the service;
  • troubleshoot technical issues;
  • enforce these Terms;
  • comply with legal obligations.

We do not claim ownership of your photos.

We do not use your photos to train artificial intelligence models.

We do not sell your photos.

We do not use your photos for third-party advertising.

7. Host Promotional Use

Unless you give us permission, Remi will not use private event photos in public marketing materials.

If you voluntarily submit testimonials, reviews, public feedback, or marketing content to Remi, you grant us permission to use that content for promotional purposes, including on our website, social media, app store listings, and marketing materials.

We may identify you by your first name, business name, event type, or public profile information if you provide that information, unless you ask us not to.

8. Prohibited Uses

You agree not to use Remi to:

  • violate any law, regulation, or third-party right;
  • upload or share content without the necessary rights or consent;
  • capture, upload, or share intimate, explicit, private, or sensitive images without consent;
  • upload or share sexual content involving minors;
  • harass, abuse, threaten, impersonate, defame, or harm others;
  • upload malware, spam, or harmful code;
  • scrape, copy, harvest, or collect data from Remi without permission;
  • interfere with or disrupt Remi’s systems, security, or infrastructure;
  • attempt to access accounts, events, galleries, or data without authorization;
  • reverse engineer, decompile, or attempt to extract Remi’s source code, except where allowed by law;
  • use Remi for illegal surveillance, stalking, doxxing, or harassment;
  • use Remi in a way that could damage, disable, overburden, or impair the service;
  • use Remi to build or train a competing product without our written permission;
  • misrepresent your identity or affiliation with any person or organization.

We may remove content, restrict access, suspend accounts, delete events, or terminate service access if we believe these Terms have been violated.

9. Takedowns and Content Removal

We may review, remove, disable access to, or refuse to host User Content if we believe, in our discretion, that the content:

  • violates these Terms;
  • violates applicable law;
  • infringes someone’s rights;
  • creates risk for Remi, users, or the public;
  • is abusive, harmful, exploitative, or unsafe;
  • is reported by a user or third party.

We are not obligated to monitor all User Content, and we do not guarantee that all harmful or unauthorized content will be detected or removed.

If you believe content on Remi violates your rights or should be removed, contact us at support@remi.camera with enough information for us to identify and review the content.

10. Copyright and Intellectual Property Complaints

If you believe content on Remi infringes your copyright or intellectual property rights, contact us at support@remi.camera with:

  • your name and contact information;
  • a description of the copyrighted work or rights you claim are infringed;
  • the URL, event name, gallery link, or other information needed to identify the content;
  • a statement that you believe the use is unauthorized;
  • a statement that the information you provide is accurate;
  • your physical or electronic signature.

We may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.

11. Remi’s Intellectual Property

Remi and its software, design, branding, logos, trademarks, graphics, features, interfaces, code, databases, workflows, and other materials are owned by Remi or our licensors.

These Terms do not grant you ownership of Remi or any Remi intellectual property.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on Remi except as expressly permitted by these Terms or applicable law.

You may not use Remi’s name, logo, brand assets, or trademarks without our prior written permission.

12. Paid Features, Purchases, and Subscriptions

Remi may offer paid events, paid storage, premium features, subscriptions, usage-based plans, or other paid products.

Prices, features, limits, taxes, billing periods, renewal terms, and cancellation options will be shown at or before purchase.

By purchasing a paid product, you authorize us or our payment processor to charge the applicable fees and taxes.

If you purchase through Apple App Store, Google Play, or another app marketplace, your purchase may be processed by that marketplace and may be subject to that marketplace’s terms, billing rules, cancellation process, and refund policies.

If you purchase directly from Remi, your purchase will be subject to the billing and refund terms shown at checkout and in these Terms.

You are responsible for reviewing all pricing, limits, renewal terms, and cancellation terms before purchasing.

13. Refunds

Unless required by applicable law or expressly stated at checkout, all fees are non-refundable once a paid event, subscription, storage plan, or premium feature has been purchased or used.

We may, in our discretion, provide refunds, credits, or extensions, but doing so in one case does not require us to do so in the future.

If a purchase was made through Apple App Store, Google Play, or another app marketplace, refund requests must be submitted through that marketplace unless otherwise stated.

14. Event and Storage Limits

Remi may limit the number of events, guests, photos, uploads, downloads, storage amount, gallery duration, or other usage depending on your plan or event settings.

We may change, add, or remove limits from time to time.

We are not responsible for loss of content caused by users exceeding plan limits, failing to download content before deletion, deleting events, failing to maintain an active account, or violating these Terms.

Remi is not intended to be a permanent archival storage service. You are responsible for downloading, backing up, and preserving any photos or content you want to keep permanently.

15. Deletion of Events, Photos, and Accounts

Hosts may delete events according to the features available in Remi.

When an event is deleted, it may be moved to a “Recently Deleted” state and permanently deleted after approximately 30 days.

Deletion may not be immediate. Copies may remain for a limited time in backups, logs, caches, or third-party systems before being overwritten or deleted in the ordinary course of business.

You may request deletion of your account by contacting us or using available in-app tools.

We may retain certain information where required or permitted by law, including for fraud prevention, legal compliance, payment records, dispute resolution, security, enforcement of these Terms, or legitimate business records.

Deleting your account may remove your access to events, galleries, and photos. It may not automatically remove photos already shared with hosts, guests, participants, viewers, or third parties.

16. Service Availability

We aim to provide a reliable service, but we do not guarantee that Remi will always be available, uninterrupted, secure, or error-free.

Remi may be unavailable due to maintenance, updates, outages, technical failures, third-party provider issues, internet issues, security incidents, or events outside our control.

We may modify, suspend, discontinue, or limit any part of Remi at any time.

We are not liable for any loss, damage, cost, or inconvenience caused by service downtime, data loss, delayed uploads, failed uploads, gallery access issues, QR code issues, email delivery issues, or third-party provider failures, except where liability cannot be excluded by law.

17. Beta Features and Changes

Remi may offer beta, experimental, early access, or preview features.

Beta features may be incomplete, unstable, changed, or discontinued at any time.

We may add, change, remove, suspend, or discontinue features, pricing, plans, storage limits, event settings, or functionality at any time.

We are not required to continue offering any feature, plan, price, or service configuration.

18. Third-Party Services

Remi may rely on or link to third-party services, including hosting providers, database providers, authentication providers, email providers, app stores, payment processors, and mobile build services.

We are not responsible for third-party services, websites, software, policies, outages, errors, security incidents, or business practices.

Your use of third-party services may be subject to their own terms and privacy policies.

19. App Stores

If you download or use Remi through Apple App Store, Google Play, or another app marketplace, you agree that:

  • these Terms are between you and Remi, not the app marketplace;
  • the app marketplace is not responsible for Remi or its content;
  • the app marketplace may have its own terms that apply to your use of the app;
  • purchases, refunds, cancellations, and subscriptions made through the app marketplace may be handled by that marketplace;
  • you must comply with applicable app marketplace rules.

Where required by an app marketplace, the marketplace and its subsidiaries may be third-party beneficiaries of these Terms and may enforce certain provisions against you.

20. Privacy

Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information.

By using Remi, you agree to our Privacy Policy.

You are responsible for ensuring that your use of Remi, including capturing or uploading photos of others, complies with applicable privacy laws and consent requirements.

21. Feedback

If you provide ideas, suggestions, feedback, bug reports, feature requests, or recommendations about Remi, you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use, modify, commercialize, and incorporate that feedback without restriction or compensation to you.

You agree that we are not obligated to use your feedback or keep it confidential.

22. Suspension and Termination

We may suspend, restrict, or terminate your account or access to Remi at any time if we believe:

  • you violated these Terms;
  • you created risk or possible legal exposure for Remi;
  • your use may harm Remi, users, third parties, or the public;
  • your account is inactive;
  • we are required to do so by law;
  • continuing to provide the service is no longer commercially or technically reasonable.

You may stop using Remi at any time.

Termination does not affect provisions that should reasonably survive termination, including ownership rights, payment obligations, disclaimers, limitation of liability, indemnity, dispute resolution, and governing law.

23. Disclaimer of Warranties

To the maximum extent permitted by law, Remi is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.

We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, security, accuracy, and uninterrupted operation.

We do not guarantee that:

  • Remi will meet your expectations;
  • Remi will be uninterrupted, secure, or error-free;
  • photos or galleries will always be available;
  • uploads, downloads, QR codes, links, emails, or notifications will always work;
  • User Content will not be lost, altered, accessed, shared, copied, or deleted;
  • unauthorized users will never access a gallery or event link;
  • defects or errors will be corrected.

Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you.

24. Limitation of Liability

To the maximum extent permitted by law, Remi and its owners, directors, officers, employees, contractors, affiliates, agents, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including loss of profits, revenue, data, photos, goodwill, business opportunity, reputation, or anticipated savings, even if we were advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to Remi or these Terms will not exceed the greater of:

  • the amount you paid to Remi for the specific event, product, or service giving rise to the claim during the 3 months before the claim arose; or
  • CAD $100.

The limitations in this section apply to all claims, whether based on contract, tort, negligence, strict liability, statute, or any other legal theory.

Nothing in these Terms limits liability that cannot be limited under applicable law.

25. Indemnity

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Remi and its owners, directors, officers, employees, contractors, affiliates, agents, service providers, and licensors from and against any claims, demands, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your use of Remi;
  • your User Content;
  • your event, gallery, QR code, invite link, or guest activity;
  • your violation of these Terms;
  • your violation of applicable law;
  • your violation of another person’s rights, including privacy, publicity, intellectual property, or contractual rights;
  • your failure to obtain required consent before capturing, uploading, or sharing photos;
  • disputes between hosts, guests, participants, viewers, or third parties.

We reserve the right to control the defence of any matter subject to indemnification, and you agree to cooperate with us.

26. Consumer Rights

Some jurisdictions provide consumers with rights that cannot be waived, limited, or excluded by contract.

Nothing in these Terms is intended to limit rights you may have under applicable consumer protection laws.

If any part of these Terms conflicts with mandatory consumer protection law, the mandatory law will apply only to the extent of the conflict.

27. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law rules.

Subject to any mandatory consumer protection laws that may apply, you agree that any dispute arising out of or relating to these Terms or Remi will be resolved exclusively in the courts located in Ontario, Canada.

28. Dispute Resolution

Before starting a legal claim, you agree to first contact us at support@remi.camera and try to resolve the dispute informally.

Your notice should include your name, contact information, account email, a description of the dispute, and the resolution you are seeking.

We will try to resolve the dispute in good faith.

Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where necessary.

29. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the “Last updated” date and may provide additional notice where appropriate.

Your continued use of Remi after updated Terms become effective means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using Remi.

30. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent.

We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.

31. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid, illegal, or unenforceable provision will be modified to the minimum extent necessary to make it valid, legal, and enforceable.

32. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later.

33. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented to you at purchase or within the service, form the entire agreement between you and Remi regarding your use of the service.
